Really interesting. It makes me think of a question that I've never been able to get a straight answer to.
If a musician performs a song that was written, recorded and owned by someone else - in a venue that was not paying them or charging or selling anything during the performance(e.g. a church) - can the performer record that performance (e.g. video) and then GIVE IT AWAY (e.g. on the web) and not be at threat of infringing anyone?
